Terms and Conditions of Equipment Loan

1. In this document, ‘members’ refers to those groups of three or more persons undertaking environmental work/projects in Rodney East, and neighbouring areas by agreement, including those groups who are not registered Members of Restore Rodney East Incorporated (RRE).

2. Prior to borrowing items, all members must agree to these Terms and Conditions including the Liability Waiver and Indemnification Form below.

3. Items shall be used solely to further the member’s environmental purposes.

4. All reservations must be made online. When returning an item to the ToolsLibrary, please ensure you also log in online to mark it as returned after physically returning it to the storage site.

5. RRE can explain the operation of items where necessary. However, by taking possession of any item, the member warrants and represents to RRE that they:

a. have no mental or physical incapacity affecting their ability to use the item safely,

b. can use the item in a safe and proper manner, including all relevant Health and Safety at Work protocols, and

c. have read and understood any safety sheets associated with the item.

6. The member must take all necessary precautions when using the borrowed item. Personal Protective Equipment should be worn where appropriate, including but not limited to, eye protection, ear protection, gloves, appropriate footwear, etc.

7. All items will be loaned for an agreed period and are to be returned to RRE on or before their return date deadline, or as requested by RRE. Items may only be returned during the RRE storage site opening hours: 6am to 7pm everyday including public holidays.

8. All items are to be returned in the same (or better, thank you!) condition as they

were issued, subject to reasonable fair wear and tear. Where appropriate please ensure all soil and vegetation is removed from items to prevent the spread of disease.

9. The member agrees to pay for the loss of any item but is not responsible to RRE for such loss if occasioned by any cause beyond the reasonable control of the member including fire, flood and criminal activity.

10. Members may renew each item for another period if (a) no other member has reserved the item and (b) the member renews the item online, by the day before the item is due to be returned. In an effort to maximize availability of items, RRE reserves the right to refuse or limit renewals.

11. The member agrees that if any borrowed item becomes unsafe or is in a state of disrepair, they must immediately discontinue use of the item and email the RRE facilitator (facilitator@rre.org.nz) of the problem on return of the item to the storage site.

12. RRE reserves the right to change these Terms and Conditions of Equipment Loan at any time, and the member agrees to abide by the most recent version, found on the lending website, each time they borrow items.

13. RRE reserves the right at any time in the future to charge a sum for borrowing certain items or in the case of consumables, for replacement of that consumable. An updated version of these Terms and Conditions of Equipment Loan will be issued at that time and lodged on the lending website.

14. The member acknowledges that they have read and understand these Terms and Conditions and has also read and signed the Liability Waiver and Indemnification Form below.

I agree to the Terms and Conditions, and recognize these may be updated from time to time and are available on the Lend Engine site.

I am capable of using the items I am borrowing. I will use the items I am borrowing in a safe and proper manner in accordance with relevant Health and Safety at Work protocols. I am aware that RRE, its officers, members, volunteers and contractors claim no expertise concerning the fitness of any item for any particular use.

In consideration of being permitted to borrow items owned by RRE, I hereby waive any and all claims against RRE, its officers, members, volunteers and contractors for any injury of any nature that I may suffer in the use of the item that I am borrowing from RRE except those caused by a defect known to RRE and not made known to me.

I agree to release, indemnify and hold harmless RRE, its officers, members, volunteers and

contractors from any liability, loss, claims, demands, actions or causes of action for the death

or injury to any persons and for any property damage suffered or incurred by any person

which may arise or be occasioned from the use or possession of items I am borrowing from

RRE.
